No existe plazo para la autorización del protocolo por el INVIMA, para las revisiones éticas locales de cada centro en estudios multicéntricos, para la certificación de Buenas Prácticas Clínicas de los centros ni para la autorización de importación de suministros. No hay consecuencia definida ante el silencio de la autoridad, ni reglas de suspensión del término. Toda jurisdicción de referencia —incluidas Guatemala, Panamá y Honduras— publica un plazo.     Cabe señalar que la propia UE considera hoy insuficiente su marco de 2014: la propuesta de Ley Europea de Biotecnología (diciembre de 2025) reduciría la autorización multinacional de extremo a extremo hacia 47 días e integraría la revisión ética. Colombia estaría diseñando su marco contra un referente que se está estrechando.

    2. Condicionar la ejecución a la carga de enfermedad nacional (artículo 25)

    Tal como está, el proyecto condiciona la ejecución de toda investigación de riesgo mayor que el mínimo —es decir, de todo ensayo clínico— a que el investigador “demuestre fehacientemente” que el conocimiento derivado responde a la carga de enfermedad nacional, a necesidades básicas insatisfechas, a la equidad o a la capacidad de respuesta ante emergencias. Es la disposición individualmente más consecuente para la posición competitiva del país: habilita la negativa de un programa global de desarrollo por razones de priorización epidemiológica nacional y contradice los propios artículos del proyecto que protegen los estudios en enfermedades huérfanas y poblaciones focalizadas. La recomendación es reformularla como exigencia de justificación del valor social y científico, no como condición de ejecución.

    3. Revisiones acumulativas en multicéntricos, sin regla de deferencia

    El proyecto exige tanto la aprobación de un “CEI referente” como la revisión por el comité de cada centro participante, sin definir qué revisa cada uno, sin plazo para las revisiones locales y sin regla de deferencia. Es el defecto de diseño que la UE resolvió con una conclusión única vinculante (Reg. 536/2014, art. 8(2)) y que Brasil resolvió con un único CEP para la investigación multicéntrica nacional (Lei 14.874/2024). Sin corrección, este numeral por sí solo puede añadir meses al inicio de estudios multicéntricos nacionales.

    4. La revisión ética y la regulatoria no se articulan como paralelas — y la evaluación científica se duplica

    El proyecto sugiere secuencialidad y permite expresamente que la evaluación científica del producto la realicen tanto el INVIMA como el CEI, habilitando la no aprobación por falencias metodológicas ya evaluadas por el regulador. La recomendación: autorizar la radicación simultánea ante el CEI y el INVIMA, delimitar alcances no superpuestos y establecer que la evaluación científica del producto por el INVIMA no se reevalúa por el CEI.

    5. Transición y vigencia crean inseguridad jurídica de duración indefinida

    El proyecto entra en vigor de inmediato con la publicación, mientras al menos cinco obligaciones sustantivas dependen de instrumentos que aún no existen —una guía técnica nacional y matriz unificada, el sistema nacional de acreditación de CEI, los procedimientos de revisión ética expedita para emergencias, las condiciones específicas de acceso post-estudio y la plena operatividad de la PNRIS—. La recomendación es una vigencia diferida general y una regla expresa de inexigibilidad de las obligaciones que dependen de instrumentos no expedidos.

    Defectos técnicos que deben corregirse con independencia de la política

    Al margen de todo debate de política, el proyecto contiene errores de redacción verificables que deben corregirse antes de su expedición — importan porque, una vez vigente la resolución, todos los documentos posteriores (Procedimientos Operativos Normalizados de los CEI, contratos con patrocinadores, actos del INVIMA) la citarán:

    • Una definición en blanco. El artículo 5 enumera “Análisis QSAR:” sin definición alguna, aunque el artículo 6 admite el QSAR como alternativa a la experimentación animal.
    • Dos capítulos “III”. Los capítulos previos a los artículos 25 y 27 están ambos numerados “III”, y la secuencia no reinicia por título — lo que dificultará la citación precisa del acto final. El artículo 27 contiene además un numeral vacío.
    • Una remisión a un parágrafo inexistente. El artículo 16 remite al “artículo 8, parágrafo 5” para las condiciones de dispensa del consentimiento; el artículo 8 tiene cuatro parágrafos, y las reglas de dispensa están en el parágrafo 3.
    • Una contradicción triple sobre revisiones sistemáticas. Las revisiones sistemáticas y los metaanálisis quedan a la vez exentos de revisión ética (art. 2), clasificados como riesgo mínimo con categorización por el comité (art. 25) y sujetos a registro obligatorio (art. 49) — tres regímenes distintos para el mismo tipo de estudio.
    • Eliminación de datos al retiro. El artículo 8 ordena eliminar o devolver los datos no anonimizados del participante que se retira, lo que es incompatible con la integridad de la base de datos de seguridad y con las propias obligaciones de conservación documental y farmacovigilancia del proyecto. El retiro debe cesar la recolección prospectiva — no destruir datos ya incorporados al análisis y al conjunto de seguridad.

    Si el Ministerio adoptara solo tres de los cambios propuestos, estos rendirían la mayor ganancia conjunta en previsibilidad — sin rebajar ningún estándar ético ni de protección del participante:

    1. Plazos máximos legales, escalonados por fase y nivel de riesgo, con reglas expresas de suspensión del término y consecuencia definida ante el silencio — aplicables tanto al CEI como al INVIMA.
    2. Un dictamen único vinculante del CEI referente con lista cerrada de motivos de discrepancia local y plazo de 15 días hábiles para la verificación local, siguiendo el modelo del artículo 8(2) de la UE.
    3. Una ruta estructurada de reliance con plazo abreviado, apoyada en la condición del INVIMA como Autoridad Reguladora Nacional de Referencia Regional Nivel IV de la OPS.

    ¿No vale la pena un proceso más lento a cambio de mayor protección?

    Esa contraposición es falsa. Las jurisdicciones que lideran la región y el mundo en volumen de investigación no lo hacen por tener estándares éticos menores, sino por tener procedimientos determinados. Un requisito que consume el tiempo de un comité de ética sin reducir el riesgo para el participante no es protección: es capacidad de supervisión desplazada desde donde importa hacia donde no importa. Todas las correcciones anteriores son procedimentales. Ninguna pide a Colombia proteger menos a los participantes.

    ¿Qué deberían hacer ahora los patrocinadores y las CRO?

    Trate a Colombia como un mercado en trayectoria de mejora y planifique para la versión de la norma que probablemente surja de la consulta:

    • Mapee ambos lados de la balanza. Planifique alrededor de las fortalezas (acceso post-estudio, póliza por riesgo, evidencia preclínica tecnológicamente neutral) y de los riesgos abiertos (plazos del INVIMA indefinidos, acumulación de revisiones en multicéntricos).
    • Prepare la documentación de reliance desde ya. Reúna las aprobaciones previas de la FDA / EMA / autoridades de referencia para estar listo si se adopta una ruta de reliance definida.
    • Asegure su estructura local frente al texto vigente. Titular de registro local, aseguramiento (póliza global con exigibilidad local) e importación — mientras hace seguimiento a la resolución final.
    • Modele los plazos con prudencia. Hasta que existan plazos legales, planifique la puesta en marcha con base en la práctica observada, no en el único plazo de 30 días del proyecto.
    • Lea a nivel de artículo. Un socio local que lea la norma artículo por artículo —no el resumen— es la diferencia entre planear para la norma como está escrita y como se aplicará.

    ¿Qué cambia el proyecto de resolución de investigación de Colombia?

    Establece los requisitos administrativos para la investigación en salud con seres humanos y deroga parcialmente la Resolución 8430 de 1993, llevando a Colombia a un modelo bipartito proporcional al riesgo, con disposiciones modernizadas de consentimiento, aseguramiento y estándares internacionales.

    ¿La nueva regulación rebaja los estándares éticos?

    No. El proyecto fortalece la protección del participante en varios aspectos. Las preocupaciones planteadas son procedimentales —plazos indefinidos, revisiones duplicadas y acumulativas, e inseguridad de transición— y ninguna requiere debilitar la protección ética para resolverse.

    ¿Cuál es el mayor problema para los patrocinadores?

    La ausencia de plazos regulatorios definidos. El proyecto contiene un único plazo perentorio en 50 páginas (30 días hábiles para el comité de ética), y hasta ese queda neutralizado; no hay plazo para la autorización del INVIMA ni consecuencia ante el silencio administrativo.

    ¿Cómo se compara el proyecto con el resto de América Latina?

    En varias protecciones sustantivas (acceso post-estudio, póliza por riesgo, neutralidad tecnológica) es competitivo o superior. En previsibilidad —plazos publicados, evaluación no duplicada, reglas de silencio y reliance estructurado— hoy queda rezagado frente a toda jurisdicción de referencia, incluidos mercados regionales más pequeños.

    ¿La regulación ya está vigente?
